Labour Market Impact Assessment (LMIA) A Labour market impact assessment (LMIA) is an official document issued by Employment and social development Canada (ESDC) that assesses the impact of hiring a foreigner in Canada. A positive LMI indicates that there is no Canadian or permanent resident to fill the position, so the employer can hire a foreign national. A negative LMIA means that a position should be filled by a Canadian citizen or permanent resident.

LMIA Application Requirements

Applications for LMIA benefits must be submitted in hard copy, through the mail, to the appropriate service center. Applications must include evidence of the following criteria having been met:
Processing Fee
All applications for LMIAs are subject to a $1,000 CAD processing fee. If the application is denied, the applicant will not receive any refund of the processing fee. Some applicants under the LMIA for in-home care providers may be exempt from this charge.
Business Legitimization Documents
Documents proving that the employer is a legitimate Canadian Business.
Transition Plan
Employer must submit a plan outlining their plans to address their need to employ foreign nationals by the end the year. Eventually, employers are meant to hire Canadians and permanent resident instead of temporary workers.Second, the old program allowed only the caregiver to enter Canada. Caregivers were not permitted to bring their dependents with them. A new program has been introduced which allows the entry of spouses and dependents at the work permit stage, along with the principal applicant.

How to be eligible for new Caregiver pilot program?

Recruitment Efforts
Employers must submit evidence that they made substantial efforts to recruit Canadian citizens and permanent residents to fill the position prior to hiring a TFW.
Wages
Applications must include information regarding the wages paid to TFWs. This will help ensure that temporary foreign workers are paid the same wages as Canadians doing the same jobs.
Workplace Safety
TFWs are entitled to the same workplace health and safety standards as Canadians in the same situation. For this reason, an employer must provide evidence that temporary foreign workers will be covered by insurance, which is at least equivalent to the health coverage provided by the province or territory in which the business is located.
